Legal Position of AgreePack

1. What AgreePack is

AgreePack is a service for recording and managing who performed a consent action, when it occurred, and which document was involved.

It is not an electronic-signature, electronic-contract, government identity-verification, or legal-advice service.

2. Records provided by AgreePack

Depending on the enabled functions, AgreePack stores and organizes:

• The document and document version presented for consent
• Information entered by the consent subject
• Consent date and time
• Operation history on the consent page
• IP address, User-Agent, and related access information
• Document registration and update history
• Information included in evidence-pack exports

3. What AgreePack does not provide

• Electronic signatures using digital certificates or signing keys
• Identity verification using official identification documents
• A guarantee that entered names or contact details are genuine
• Legal review of uploaded documents
• A guarantee that consent or a contract is valid or enforceable
• A guarantee of admissibility or evidentiary weight in court
• Legal advice from attorneys or other professionals
• A guarantee that disputes will be prevented or resolved

4. Difference from electronic signatures

Under Japanese law, an electronic signature generally refers to measures used to confirm authorship and detect alteration of an electronic record. Certain electronic signatures may support a presumption that a record was authentically created.

AgreePack does not apply electronic signatures using certificates or signing keys. Consent actions recorded in AgreePack therefore should not be described as equivalent to an electronic signature under the Electronic Signatures Act.

5. Validity of consent recorded in AgreePack

The legal validity of consent or a contract is not determined solely by the use of AgreePack.

It may depend on the explanation given, identity-verification method, genuine intent, document contents, legally required formalities, procedures for minors or legal representatives, and other circumstances.

AgreePack organizes records that may form part of that assessment, but does not guarantee validity.

6. Use as evidence

Records stored by AgreePack may be used as materials to explain what occurred between the parties.

Their evidentiary value depends on the record contents, identity-verification method, document and record management, consistency with other evidence, possibility of alteration, and the nature of the dispute.

AgreePack does not guarantee that a record will be admitted or given any particular evidentiary weight.

Users determine the contents, explanations, input fields, and consent process for documents uploaded to AgreePack.

Users must confirm that documents are suitable for their purposes, contain necessary explanations, comply with applicable laws and industry rules, and do not infringe third-party rights.

AgreePack does not perform individual legal review of uploaded documents.

Free templates, examples, and articles provided by AgreePack are general reference materials.

They are not guaranteed to fit a specific business, treatment, contract, jurisdiction, person, or legal requirement. Users should review and revise them and seek professional advice when appropriate.

11. Handling personal information

Users are responsible for providing required notices, obtaining consent, and taking other necessary steps when handling consent subjects’ personal information through AgreePack.

When collecting sensitive information such as medical history or health information, users should comply with applicable privacy laws and industry guidance and avoid collecting unnecessary data.
